There’s a lot of paperwork, deadlines, and regulations involved if you’re trying to get workers’ compensation benefits in Kansas. Some important things to keep in mind include:

  • Employers with an estimated annual payroll of more than $20,000 are required to carry workers’ compensation insurance.
  • Your worker’s compensation claim may be denied if you fail to notify your employer within 20 days of suffering a job-related injury or disability.
  • If you no longer work for that employer, you have 10 days from your last day at that job to report an injury or disability related to that job, or your claim may be denied.
  • Employers are required to provide reasonable medical treatment to injured workers.
  • Employers have the legal right to authorize which doctors an injured worker can visit.
  • Injured workers can visit unauthorized doctors, but the insurance company is only required to pay for $500 worth of treatment from medical providers who aren’t authorized.
  • Injured employees who qualify workers’ compensation benefits may be eligible to receive 2/3 of their gross average weekly wages as long as that amount does not exceed 75 percent of the state’s average weekly wage at the time of the injury.
